Managing government property comes at a cost. Contract managers often overlook cost and pricing issues relating to government property in both the pre-award and post-award phases of the contract lifecycle. . . Avoid costly oversights by recognizing and properly estimating the cost and pricing impact of property management from the beginning. This discussion will address: Profit on the acquisition of equipment; costs related to government property loss, theft and damage; the withdrawal and disapproval of a Property Management System; and the potential hidden costs of disposing of government property.

Title: The New Buy American Executive Order 14005: Examining the American Supply Chain and How Contractors Can Influence It
In a flurry of executive orders signed on January 20th, President Biden signed EO No. 14005, “Ensuring the Future is Made is All of America by All of America’s Workers.” While it’s clear that the administration seeks to bolster preference for American-made goods and services, first set through the Buy American Act, signed in 1933, the path forward for the acquisition community is nebulous. How can a supply chain that has long relied on global economies be adjusted to actually “buy American?” In this discussion, Dan Finkenstadt and Rob Handfield will frame the current state of our supply chain, outline the main points of the executive order, and make key recommendations as to how the contracting community can use market intelligence, category strategy, and solutions management in private markets to begin to respond to this imperative.

On January 1, 2021, the National Defense Authorization Act for Fiscal Year 2021 took effect after Congress overrode President Trump’s December 23, 2020 veto. This Act contains numerous provisions that will impose new requirements, expectations, and opportunities for government contractors. The recent ban of contractor use of telecommunications and surveillance services and technology manufactured by certain Chinese companies is one of the most significant rules issued by the FAR Council in the last few years. The ban impacts all contractors and contracts without regard to size or what the contractor sells and includes equipment that will not be delivered to the government customer. The webinar will cover all of the rule’s basics, take a deep dive into some of the rule’s nuances, and provide practical compliance and risk mitigation approaches.

Michael
Levy is Counsel and Contracts Manager at NORC at the University of
Chicago—an objective, nonprofit research institution that delivers
reliable data and analysis to help guide critical programmatic,
business, and policy decisions. He has broad expertise with
cybersecurity issues in government contracts and has advised both
industry and U.S. government agencies on cybersecurity regulations.
Previously, he was a Manager in the contracts organization at Northrop
Grumman Corporation, and a practicing attorney for state and local
governments.

With three Executive Orders and two Presidential Memoranda issued in the last few weeks, Defense Production Act (DPA) policy is developing quickly. The U.S. Department of Health and Human Services (HHS) now has the authority to place rated orders under the Federal Priorities & Allocations System (FPAS) for equipment and resources to respond to the COVID-19 pandemic. FPAS-rated orders present both opportunity and risk. This discusses what contractors need to know about the FPAS program, what their obligations and rights are when they receive a rated order, and what remedies are available.
