DOD Authorizes DOD Litigation Support Contractors to Access Sensitive Information Under Certain Conditions

On February 28, 2014, DOD issued an interim rule amending the DFARS to grant DOD litigation support contractors the authority to access sensitive information (confidential, commercial, financial, or proprietary information; technical data; or other privileged information) so long as the contractor abides by certain restrictions on the use and disclosure of such information. Restrictions include prohibitions on litigation support contractors using the sensitive information for any purpose other than litigation support services to DOD and prohibitions on the unauthorized disclosure of sensitive information. DOD will, to the maximum extent possible, inform offerors submitting information to DOD under solicitations and contracts that the submitted information may be disclosed to DOD litigation support contractors. The rule implements Section 802 of the National Defense Authorization Act for Fiscal Year 2013 (Pub. L. 111-383). Written comments on the proposed rule should be submitted on or before April 29, 2014. (79 Fed. Reg. 11337, 2/28/2014.)
