NASA Proposes to Clarify that Nonprofits are not Entitled to Profit from Fees on Grants and Cooperative Agreements

On February 25, 2014, NASA issued a proposed rule to update its regulations and clarify that Federal Financial Assistance awards—i.e., grants and cooperative agreements—do not provide for the payment of fees or profit to nonprofit organizations. The proposed rule is intended to address an ambiguity in the current rules, which explicitly prohibit the payment of fees or profit to commercial entities under Federal Financial Assistance awards, but do not address nonprofit organizations. Written comments on the proposed rule should be submitted by April 28, 2014. (79 Fed. Reg. 10436, 2/25/2014.)
