FHA Revises Design-Build Contracting Requirements

On February 12, 2014, the Federal Highway Administration (FHA) issued a final rule revising the regulations governing the use of alternate technical concepts (ATC) in design-build projects for highway construction. Under the final rule, contractors are no longer required to submit a base proposal when submitting an ATC-based proposal. This change reflects the agency’s determination that such base proposals are no longer necessary in order to conduct a fair comparison of proposals. The final rule became effective March 14, 2014.
