DOD, GSA, and NASA Issue Proposed Rule to Reflect SBA Overhaul of 8(a) Program

On February 3, 2014, DOD, GSA, and NASA issued a proposed rule that would align the FAR with revisions SBA made to the 8(a) contracting preference program in 2011. The proposed rule would:

The proposed rule would also prohibit Alaska Native Corporations, Indian Tribes, Native Hawaiian Organizations, or Community Development Corporations from receiving 8(a) sole-source awards as a follow-on to an 8(a) contract. Finally, the proposed rule would establish procedures for protesting the size status of an apparent successful offeror for a competitive 8(a) award and for seeking a formal size determination as to the size status of an 8(a) participant nominated for award of a sole-source contract.
