DOD Amends DFARS Coverage for Contractors Performing Private Security Functions to coincide with the FAR

On November 18, 2013, the Department of Defense (DOD) issued a final rule amending the Defense Federal Acquisition Regulation Supplement (DFARS) to eliminate provisions duplicative of those contained in the Federal Acquisition Regulation (FAR). The DFARS provisions removed under the rule are DFARS 225.370 and the clause at 252.225-7039, which were applicable to contractors performing private security functions. Because subsequently implicated FAR provisions covered the issue sufficiently, the DFARS provisions were removed under this rule as duplicative and unnecessary. This rule became effective November 18, 2013. (78 Fed. Reg. 69282, 11/18/2013.)
