DOE Proposes to Update and Improve Text of Certain DEAR Clauses

On November 7, 2013, the Department of Energy (DOE) issued a proposed rule to amend the Department of Energy Acquisition Regulation (DEAR) to update and improve certain intellectual property and technology transfer clauses. These updates are designed to improve the clarity of these DEAR provisions based on years of experience with the clauses, make technical and grammatical changes, and make some clauses consistent with recent changes to the Federal Acquisition Regulation. The proposed rule affects DEAR clauses related to computer software, trademarks, technology transfer to foreign entities, weapons-related inventions, and background technology rights. Changes made pursuant to this rule would not alter the substantive rights or obligations under current law. (78 Fed. Reg. 66865, 11/7/2013.)
