DOD, GSA, and NASA Expand the Definition of “Contingency Operation”

On August 1, 2013, DOD, GSA, and NASA issued a final rule amending the FAR definition of “contingency operation” to include a response to a presidential declaration of a major disaster. This change reflects changes to the statutory definition made by the National Defense Authorization Act for Fiscal Year 2012 and will allow defense and civilian agencies to raise acquisition thresholds—i.e., micropurchase and simplified acquisition thresholds—for acquisitions made in support of emergencies meeting the new definition. The new rule became effective August 1, 2013. (78 Fed. Reg. 46781, 8/1/13.)
