DOD Proposes Systems to Detect and Avoid Counterfeit Electronic Parts

On May 16, 2013, DOD issued a proposed rule to amend the DFARS by requiring contractors to establish and maintain counterfeit electronic part avoidance and detection systems. Such systems would have to include:

Under the proposed rule, contractors would also be responsible for the costs of remedying any counterfeit parts provided to the government unless they could demonstrate that it had a detection and avoidance system in place, the counterfeit part was government-furnished property, and the contractor provided notice to the government. These changes would implement portions of the NDAA for Fiscal Year 2012 and NDAA for Fiscal Year 2013. Comments on the proposed rule must be submitted by July 15, 2013. (78 Fed.
