DOD, GSA, and NASA Revise the Definition of “Contingency Operation”

On February 28, 2013, the Department of Defense (DOD), the General Services Administration (GSA), and the National Aeronautics and Space Administration (NASA) issued an interim rule to revise the definition of “contingency operation” to include instances when the secretary of defense activates reserves under 10 U.S.C. 12304a in order to provide assistance requested by a governor in response to a major disaster or emergency declared by the president. This change reflects statutory changes made by the National Defense Authorization Act for Fiscal Year 2012 (Pub. L. 112-81). Written comments on the interim rule should be submitted on or before April 29, 2013. (78 Fed. Reg. 13765, 2/28/2013.)
