DOD Requires Written Notification for Incumbent Contractors Prior to In-sourcing

On October 31, 2013, the Department of Defense (DOD) issued an interim rule requiring contracting officers to give written notification to incumbent contractors that would be affected by a government in-sourcing determination. The rule implements section 938 of the National Defense Authorization Act of 2012 and requires the contracting officer to provide notice within 20 days of receiving the in-sourcing decision. Until this notice is provided, the government cannot initiate any formal hiring or contract-related actions, except for preliminary internal actions associated with hiring or contract modification. Comments on the proposed rule must be submitted on or before December 30, 2013. (78 Fed. Reg. 65218, 10/31/2013.)
