DOD Simplifies Commercial Item Contract Drafting

On June 25, 2013, DOD issued a final rule amending the DFARS to simplify the process for determining what provisions and clauses are applicable to commercial item acquisitions and for identifying flow-down clauses for commercial subcontracts. Under the new rule, the DFARS will contain a single list of contract clauses that may be included in commercial item contracts. Previously, the information was scattered throughout several DFARS provisions. The final rule became effective June 25, 2013. (78 Fed. Reg. 37980, 6/25/13.)
