House Introduces Bill Requiring Price and Other Factors to be Weighed Equally in Evaluating Proposals

On March 13, 2013, Rep. Alan Grayson (D-FL) introduced a bill (H.R. 1109) regarding the relative weight to be given to cost or price versus other criteria when evaluating technical proposals. If passed, the yet unnamed bill would require the Department of Defense to give cost or price at least equal weight as all other evaluation factors when evaluating competitive proposals. The bill would also give agency heads nondelegable authority to waive this requirement and would require agencies to submit to Congress and publicly post a list of all waivers issued each fiscal year. The bill has been referred to the House Committee on Armed Services.
