House Introduces Bill Mandating Debarment Proposal for NLRA Violations

On December 13, 2012, Rep. Dennis Kucinich (D-OH) introduced the “Workers Solidarity Act of 2012” (H.R. 6668). If passed, the bill would mandate that entities be proposed for debarment if, by final order or decision, they have been found to have engaged in unfair labor practices in violation of section 8(a) of the National Labor Relations Act (NLRA). The bill also contains a mandatory flow-down provision and, if passed, prime contractors would be required to ask subcontractors (at any tier) to certify that no final order or decision has been issued declaring them in violation of section 8(a) of the NLRA. The bill has been referred to the House Committee on Oversight and Government Reform.
